LA UNP Y FUNCIONARIOS SE CONVIERTEN EN FICTOS DETERMINADORES DE DESPROTECCIÓN

LA UNIÓN NACIONAL DE PROTECCIÓN EXPONE AL PELIGRO INMINENTE DE MUERTE A ATHEMAY STERLING ABOGADO DEFENSOR DE LOS DERECHOS HUMANOS EN COLOMBIA DIRECTOR CPDH VALLE

En el día de hoy a medio día, de infracto por Orden de Guardianes Colombia,  Edgar Girón de la Empresa Privada Guardianes contratista de la Unidad Nacional de Protección asistió a una residencia de seguridad del Doctor Athemay Sterling Acosta quien tiene medidas cautelares otorgadas por la Comisión Interamericana de Derechos Humanos de la OEA, además es Abogado reconocido Defensor de los Derechos Humanos en Colombia, Director e integrante del Comité Permanente por la Defensa de los Derechos Humanos en Colombia y de Derecho Preventivo y Derechos Humanos de Colombia, víctima y reclamante de tierras por ser desplazado por los paramilitares, víctima de varios atentados y amenazas de muerte, etc., litigante nacional e internacional de Derechos Humanos para indicarle verbalmente que la protección se le terminaba, y que el Señor Girón  “…quedaba muy preocupado por dejar al Doctor Athemay Sterling Acosta sin la debida protección y expuesto al peligro inminente… pues el Doctor Sterling de verdad requiere protección del Estado Colombiano por su altísimo riesgo de muerte que tiene…” palabras muy dicientes y verdaderas del Directivo de Guardianes quien presta la seguridad y protección al Director del CPDH Valle y de CDPDH en nombre de la UNP.

Andrés Girón cuando asistió hoy a medio día a una de mis residencias de seguridad lo hizo de manera arbitraria e ilegal presionando notificación de un ficto acto y escrito que no llevaba en físico. 

Situación de Andrés Giron muy sospechosa pues agudiza la vulneración a los Derechos y a la Ley conociendo como Yo le informé a este señor que existía de por medio una Acción Judicial y sin embargo insistía ilegalmente sus propósitos no autorizados. 

Athemay Sterling Acosta excandidato popular por el Polo Democrático Alternativo en las últimas elecciones a Gobernador del Valle del Cauca, ex Consejero y ex Asesor de Paz Departamental  y hoy Candidato al Senado de la República a través del Frente Amplio Popular que avala y coadyuva este Derecho de Petición y denuncia a la UNP y al Ministerio del Interior de Colombia y por supuesto Petítum Constitucional e información al señor Presidente Juan Manuel Santos y a la Vicepresidencia de la República en sus Organismos de DDHH y DIH conocedores del caso y coadyuvantes para la protección del Doctor Athemay Sterling Acosta, quien hace parte de la Oposición Política Colombina de manera pública y notoria, y además es impulsor determinante del proceso de la defensa de los Derechos y de la Paz con Justicia Social junto al apoyo total a los Diálogos en la Habana entre las Farc-Ep y el Gobierno, Athemay Sterling Acosta es sobreviviente y demandante en el Caso del Genocidio Político y agresión estatal y paramilitar contra la Unión Patriótica de la cual Athemay Sterling Acosta y la militancia de Base de la UP convocan al Quinto Congreso Nacional de la UP para Septiembre 13, 14 y 15 de Septiembre de 2013.

Lo irregular y despropósito jurídico es que el Estado Colombiano vulnere los Derechos a Athemay Sterling Acosta quien tiene medidas cautelares otorgadas por un Organismo de Derecho Internacional, un Tribunal Internacional de Derechos Humanos, en este caso de la OEA, que no puede desconocer la UNP, que era quien debía notificar personalmente de su error y acción antijurídica de desprotección a un dirigente nacional de DDHH altamente amenazado como el Dr. Athemay Sterling Acosta con protección Internacional de la OEA, y de su máximo Tribunal la CIDH, y que la UNP deja en peligro  a Sterling, quedando así la Unidad Nacional de Protección UNP, responsable directa y a la vez en concordancia  ficta determinadora de cualquier situación criminal que agreda la vida e integridad personal, psíquica, física, profesional, etc., del Dr. Athemay Sterling Acosta , su familia y equipo de trabajo quien ya impetró ante la Justicia Colombiana las acciones judiciales pertinentes y ofició a la OEA, la ONU y a la Federación Internacional de Derechos Humanos FIDH de la cual es filial el CPDH y por lo tanto Athemay Sterling Acosta, e igualmente haremos nosotros y las diferentes Organizaciones de Derechos Humanos y Colegios de Abogados, junto a la Academia y Grupos Científicos de Investigación registrados y categorizados en Colciencias, como el Grupo de Investigación Palenque quien avala y coadyuva esta denuncia pública y requerimiento en el marco de los preceptos 11, 23 y concordantes Constitucionales para que la UNP rectifique su error y restaure la Protección Reforzada y ordenada por Sentencia Judicial Internacional que anexamos con numeración MC 323/11  de la OEA  y por orden de la Justicia Colombiana, que la UNP nunca puede desconocer.

MC 323/11 – Miembros del Comité Permanente por la Defensa de los Derechos Humanos y sus Seccionales, Colombia

El 9 de mayo de 2012, la CIDH otorgó medidas cautelares a favor de Edgar Montilla, Martín Sandoval, Athemay Sterling y Diego Alejandro Martínez Castillo, así como de los integrantes de los Seccionales Bogotá, Huila, Nariño y Arauca del Comité Permanente por la Defensa de los Derechos Humanos (CPDH), en Colombia. La solicitud de medida cautelar alega que los integrantes del CPDH en Bogotá y en 14 seccionales en el país han sido objetos de amenazas, señalamientos y hostigamientos desde 2009. Alegan que, a pesar de haber solicitado medidas de protección, a algunos no les habrían sido concedidas y en otros casos serían insuficientes e inefectivas. La CIDH solicitó al Estado de Colombia adoptar las medidas necesarias para garantizar la vida y la integridad física de Edgar Montilla, Martín Sandoval, Athemay Sterling y Diego Alejandro Martínez Castillo, así como de los integrantes de los Seccionales Bogotá, Hila, Nariño y Arauca del Comité Permanente por la Defensa de los Derechos Humanos; concertar las medidas a adoptarse con los beneficiarios y sus representantes; e informar a la CIDH sobre las acciones adoptadas a fin de investigar los hechos que dieron lugar a la adopción de medidas cautelares.

11.          On May 9, 2012, the IACHR granted precautionary measures in favor of Edgar Montilla, Martín Sandoval, Athemay Sterling and Diego Alejandro Martínez Castillo, and of the members of the Sections Bogota, Huila, Nariño and Arauca of the Comité Permanente por la Defensa de los Derechos Humanos (CPDH, or Permanent Committee for the Defense of Human Rights), en Colombia. The request for precautionary measures alleges that the members of the CPDH in Bogota and 14 sections in the country have been subject of threats and harassment since 2009. They allege that, although they requested protection measures, some have not been granted and the others are insufficient and ineffective. 12.          On June 11, 2012, the IACHR granted precautionary measures in favor of Hernán Henry Díaz, in Colombia. The IACHR received information on April 25 and 27, 2012, about the alleged forced disappearance of Hernan Henry Díaz, a peasant leader, member of the Coordination of Social, Peasant, Afrodescendant and Indigenous Organizations of the Department of Putumayo, member of the National Federation of Agricultural Farming Unions, and leader of the social and political movement Marcha Patriótica (Patriotic March). According to the information received, the last time that anyone heard from Hernán Henry Díaz was on April 18, 2012, when through a text message he communicated that he was in his way to Bogota to participate in the launching of the “Marcha Patriótica”. Through the precautionary measure, the IACHR requested the State of Colombia to immediately adopt the necessary measures to determine the situation and whereabouts of Hernán Henry Díaz and to protect his life and personal integrity; and to inform the Commission about the actions taken to investigate the facts that led to the adoption of precautionary measures.

PM 269/10 – Manuel Junior Cortéz Gómez and Yolanda Gómez Torres, Colombia

13.          On June 22, 2012, the IACHR granted precautionary measures in favor of Manuel Junior Cortéz Gómez and Yolanda Gómez Torres, in Colombia. The request for precautionary measures alleges that Manuel Junior Cortéz Gómez is the only survivor of an alleged massacre of a soccer team, which was allegedly executed in October 2009 in Venezuela, near the border with Colombia, by a grup that calls itself Fuerza de Liberacion Bolivariana. The request alleges that after the alleged massacre, Manuel Junior Cortéz Gómez and Yolanda Gómez Torres cooperated with the Judiciary, and that afterwards the threats and harassment against them started. Additionally, it is indicated that on June 6, 2012, Manuel Junior Cortéz Gómez was attacked and stabbed, and was hospitalized in serious condition. The IACHR requested the State of Colombia to adopt the necessary measures to guarantee the life and physical integrity of Manuel Junior Cortéz Gómez and Yolanda Gómez Torres, to adopt the measures in consultation with the beneficiaries and their representatives, and to inform on the actions taken to investigate the facts that led to the adoption of precautionary measures.

PC 225/12 – Alfamir Castillo, Colombia

14.          On October 17, 2012, the IACHR granted precautionary measures for Alfamir Castillo, in Colombia. The request for precautionary measures alleges that Alfamir Castillo was subject to repeated death threats and persecution. According to the petition, on August 28, 2012, someone on a motorcycle fired two shots into the air while passing by her, and on October 10, 2012, an unknown individual pointed a gun at her chest and threatened her with death. The request indicates that these actions were linked to her participation in the criminal investigation into the death of her son. The IACHR asked the government of Colombia to adopt any necessary measures to guarantee the life and physical integrity of Alfamir Castillo, reach agreement with the beneficiary and her representatives on the measures to be adopted, and inform the Commission about the steps taken to investigate the events that led to the adoption of precautionary measures.
